By using the websites of Markets West Office Furniture, Inc. (Markets West), you agree to the following terms and conditions:
Welcome to the www.marketswest.com and websites (collectively, the "Websites"). The Websites are Internet properties of Markets West Office Furniture, Inc (aka "Markets West", "us", "our" or "we") and are owned by Markets West. Your use of the Websites is subject to your agreement with the terms and conditions set forth herein below (the "Agreement"). Please read this Agreement carefully before using the Websites. By using the Websites, you acknowledge your receipt of, and consent to, this Agreement and any subsequent modifications made hereafter. Markets West may modify this Agreement at any time without prior notice to you. Such modifications shall be deemed effective upon the posting of the modified Agreement at the Websites. You agree to periodically review the Agreement made available on the Websites in order to remain apprised of any and all subsequent modifications. Your continued use of the Websites shall be deemed your conclusive acceptance of the Agreement then in effect.
Website Color and Material Samples
Digital surface material & fabric images are provided as a preliminary color reference and should not be used for final color selection. Due to individual computer/monitor settings: color, texture, and pattern size may vary from the actual sample. We recommend that you request physical samples if accurate color is required.
Product Info and Specifications
We continually strive for accuracy and thoroughness when it comes to describing our products. However, we do not warrant that product descriptions or other content contained on the Website(s) are entirely accurate, complete, reliable, current, or error-free. If you find a product is not as described, your sole remedy is to return it in unused condition. Please inform of us any information you think is inaccurate and contact us before purchase if you have any doubts or questions on product specifications.
Product information accessed through the website(s) is obtained from claims made by the product's manufacturer. On occasion, manufacturers may alter their labels so actual product packaging and materials may contain different information than that shown on our websites, thus we cannot guarantee or ensure the accuracy, completeness or timeliness of any product information. We recommend that you do not solely rely on the information presented and that you always read labels, warnings, and directions before using a product. For additional information about a product, please contact the manufacturer directly. We assume no liability for inaccuracies or misstatements about products.
All online purchases or purchases to be shipped out of Phoenix must be paid in full before orders are placed with vendors/manufacturers. For local purchases, invoices are payable in full at time of local delivery or customer pick up. Merchandise will not be left at the delivery premises if payment is withheld for any reason. Customer agrees to withhold not more then 10% of invoice item total for items requiring service at time of delivery. Returned checks, for any reason, will incur a $30.00 processing fee. All outside funding must be received within 10 days after delivery. In the event customer can't take delivery of items, all orders held over 10 days must be paid in full. All payments are due and payable in Phoenix, AZ. Customer agrees to pay late fee of 1.5% per month on all past due amounts, plus all reasonable attorneys fees incurred for collection.
Custom/Special Orders/Made to Order
Custom & Special orders and Made to Order products are designated as such in the item description. All special orders require a 100% non-refundable payment before order is placed with the vendor/manufacturer. Custom/Special orders are non-cancelable and non-refundable.
Used and As-Is Furniture
All used furniture is sold as-is. No holds, returns or refunds. Note: We do not ship used or as-is merchandise. These items are available for local delivery in the Metro Phoenix area and for customer pickup here at our Central Phoenix location.
Product Lead Times
Lead Times for Stock and Special orders are based on average past shipping experience from our suppliers. Delays beyond the control of Markets West may occur and as such expected delivery dates are only approximate. Markets West cannot guarantee specific delivery dates and is not responsible for factory or weather delays.
In-stock and clearance (excluding used furniture) product may be returned within 5 working days of purchase. A refund will be issued pending inspection on the product only; delivery charges will be incurred unless a customer pick-up (CPU). Any item not returned in original condition may be assessed a restock fee. Special order (*) items are non-returnable or refundable. Requests for refunds will be processed within approximately 2-3 business days for credit card purchases and 10 business days for check purchases and must be accompanied by proof of purchase. Delivery & Installation
Our delivery personnel are responsible for installing only the furniture indicated on the order. An additional fee will be charged to move existing property to complete the delivery. We will not move or disconnect any electronic media device including computers to facilitate delivery without the expressed written permission of the owner or authorized agent. Markets West assumes no liability for damage [including software applications and networks] as a result of any action so authorized. Electrical work must be done by a licensed electrician. Unforeseen complications requiring non-scheduled after-hours delivery, elevator personnel, hoist or lift equipment will incur an additional charge. Markets West personnel are not authorized to hang art or move electronics, etc. This service is available for a nominal fee from independent installers. Rescheduled deliveries may be assessed a re-delivery fee. See Shipping, Delivery & Setup for more info.
Quoted times of day for deliveries are approximate only and are influenced by shipping delays, weather, and traffic conditions beyond our control. Markets West assumes no liability for consequential damages for any reason. Delivery times that are restricted to specific time frames, after normal business hours (9am to 5pm) or Saturday's will incur additional fees.
Customer Pick Up
Markets West personnel will assist customers who wish to pick up their purchases. Markets West assumes no liability for property damage or personal injury as a result of such action. Items must be returned to the dock for warranty work.
Please inspect your new furniture purchases carefully. All defects and exceptions must be noted on the delivery receipt. Markets West assumes no responsibility for merchandise after it leaves our premises or is signed for in good condition. Service work may be provided for an additional fee. Clearance & as-is product may be touched up for a fee.
Warranty and Service Policy
Markets West does not warranty the furniture we sell directly but as a dealer, facilitates the manufacturers warranty. The exception is our Refurbished Cubicles which we do warranty directly. If you have a warranty issue please contact us and we will assist you to get your issue resolved. For regularly stocked items under warranty we can usually repair or replace your item quickly. Items brought back to our showroom/warehouse can be processed for free. If we have to pickup and deliver your item there may be a nominal labor charge. Items returned to the factory for repair may incur freight and shipping fees. There is no warranty on glass tops. Please discontinue the use of damaged or defective product until repairs have been completed. Product picked up at Markets West must be returned to our dock for warranty work. Used, Closeout, Final Sale, As-Is, Damaged items ARE SOLD ON AN "AS-IS BASIS, AND MARKETS WEST OFFICE FURNITURE, INC. DISCLAIMS ANY IMPLIED WARRANTIES WITH RESPECT TO SUCH ITEMS.
